2. Services & Scope of Work
Visually Art provides a range of advertising, design, and printing services. The specific scope of work for any project will be detailed in a formal proposal or service agreement, which will be provided to you before the commencement of any work. This agreement will outline deliverables, timelines, and costs.
3. Payment Terms
Payment terms will be specified in the project proposal or invoice. Typically, a deposit is required before work begins, with the balance due upon project completion and prior to the release of final files or printed materials. Late payments may incur interest charges as permitted by law.
4. Intellectual Property Rights
Upon full payment, the client is granted a license to use the final design for the purposes agreed upon in the scope of work. Visually Art retains the right to use the work for promotional purposes, such as in our portfolio. All preliminary concepts and unused designs remain the intellectual property of Visually Art.
5. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the project. This includes business strategies, client data, and trade secrets.
6. Limitation of Liability
Visually Art's liability for any claim arising from our services is limited to the total fees paid for the specific project in question. We are not liable for any indirect, incidental, or consequential damages.
7. Termination
Either party may terminate the service agreement with written notice. If the client terminates the agreement, they will be responsible for payment for all work completed up to the date of termination.
8. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Visually Art is located, without regard to its conflict of law provisions.
